On August 5, the Quality Brands Protection Committee of China Association of Enterprises with Foreign Investment (QBPC) Pharmaceutical & Medical Devices Industry Working Group (P&MD IWG) held a lunch meeting simultaneously in Beijing and Shanghai. Ji Ying, coordinator of the P&MD IWG, hosted the event which was at tended by 21 representatives from 14 member companies both online and offline.
The participants reviewed the status of various projects of the P&MD IWG this year and proposed that P&MD IWG join other IWGs tohold exchange meetings with Internet platforms as well as visiting the procuratorate on public interest litigation. Daisy Ge of Johnson &Johnson briefed on the progress of IP protection projects on specific Internet platforms, and the participants also shared common obstacles and challenges in IP protection and put forward relevant suggestions. Lance Lu of BeiGene explained his views over issues related to thelatest judicial interpretation ,such as the standard of "enough to seriously endanger human health" in Article 7 , the determination ofaccomplices in Article 9, the determination of subjective intent in Article 10, the practical determination of Medical Insurance Fraud ofArticle 13 and practical identification of counterfeit and inferior drugs of Article 19 and the specific application of Articles 15, 16, 17 and20. Meanwhile he shared his experience with specific cases. The participants were very concerned about these issues and had a livelydiscussion. Finally, Ji Ying thanked all members for attending the event and looked forward to meeting up next time.
