On the morning of August 10, Quality Brands Protection Committee of China Association of Enterprises with Foreign Investment (QBPC) Chair Michael Ding led a QBPC group to call on the Qingdao Intermediate People’s Court and held a discussion on the protection of IPR with the judges.
Michael Ding introduced the history, structure and priorities of the QBPC. As a star project of QBPC, the Annual Top Ten Cases Selection had been held for 21 times. The selected cases were all highly representative and forward-looking, reflecting the hot and difficult issues of IPR, which were well acknowledged by the judicial and law enforcement departments at central and local levels. The number of candidate cases was as high as 74 this year, making it the most competitive in history. Two cases handled by Qingdao Intermediate People’s Courtwon the QBPC 2021-2022 Annual Top Ten Cases.
Qingdao Intermediate People's Court is one of the earliest courts in China to establish the Intellectual Property Tribunal and the first batch of IP research bases approved by the Supreme People's Court (SPC). After its establishment in September 2017, the IP Tribunal had cross-region jurisdiction over technical IP cases in six cities on the Jiaodong Peninsula. For many years, it had adhered to high-quality trials, smart trials and "one plus four" working mechanism. It had actively carried out concise research around the core tasks ae well as actively conducted circuit trial and cross-regional injunction, built the "Qingdao IP"brand. Many cases had won "Top 10 Intellectual Property Cases of Chinese Courts", "Top 10 Intellectual Property Cases of Shandong Courts", "50 Typical Intellectual Property Cases" and had been awarded the QBPC 2021-2022 Annual Top Ten Cases for many consecutive years. Since it was established five years ago, the IP Tribunal had accepted more than 8000 cases, the total number of cases handled last year reached more than 1,700, and the annual record number of cases handled per judge was over 200. At the same time, the Qingdao Intermediate People's Court applied the 3D evidence management system to break through the technical difficulties of evidence collection, actively carried out the "Qingdao IP" series of training, continuously improved the professionalism of judges, and ensured the quality of trials. In recent years, the Qingdao IP Tribunal had made remarkable achievements in intellectual property protection and become the preferred place for dispute resolution in the field of intellectual property rights.
In the exchange session, the two sides conducted an in-depth discussion on the Shandong provincial judicial practice of IPR and the common concerns of rights holders on the platform of the QBPC.
