The 3rd Online Session of INTA-QBPC Case Sharing Series: Criminal and Civil Cases

On December 1, Quality Brands Protection Committee of CAEFI (QBPC) and International Trademark Association (INTA) jointly hosted the 3rd online session of INTA-QBPC Case Sharing Series in 2022, which focused on the best practice sharing of QBPC 2021-2022 Annual Top 10 Criminal and Civil Cases. Kelvin Liu, Vice Chair of QBPC Best Practices/Enforcement Committee, moderated the meeting. More than 30 people including QBPC Chair Michael Ding and Chief Representative Officer of INTA Asia-Pacific & China Office Seth Hays attended.

 

First of all, IP Director of Emerson Frank Liu introduced in detail two cases nominated by Emerson and awarded as the QBPC Annual Top Ten Cases, concerning the used refurbishment of industrial products and the infringement of others' trademarks constituting unfair competition respectively. He shared his thoughts on the intellectual property issues of refurbished used goods, and the challenges and solutions of trademark infringement.

 

Afterwards, IP Director of Schneider Electric Paul Lu shared his experience and strategies in criminal and civil protection of intellectual property through two Schneider cases of counterfeit products of registered trademark and disputes over infringement of trademark rights.

 

In the Q&A session, the online participants raised a few of typical questions on the third-party identification of refurbished product quality, the source of case clues, and whether bad-faith trademark registration constituted unfair competition. The two speakers gave detailed and wonderful answers.

 

The 4th session of online case sharing between the QBPC and INTA is under planning. Please stay tuned.
