Keynote Speech Session of May General Membership Meeting of Quality Brands Protection Committee of China Association of Enterprises with Foreign Investment

On the morning of May 12, 2016, Keynote Speech Session of May General Membership Meeting of Quality Brands Protection Committee of China Association of Enterprises with Foreign Investment was held in JW Marriott Hotel Beijing Central, QBPC Chairman Colin Chen addressed welcoming remarks. Mr. Bob Peeters, Senior Manager of WCO IPM Private Sector Team, Ms. Duan Xiaomei, Director of SAIC Trademark Review and Adjudication Board, Mr. Lin Guanghai, Vice President of Guangzhou IP Court and Mr. Huang Yong, Professor of University of International Business and Economics School of Law were invited to participate in the meeting and delivered speeches.

 

To begin with, Mr. Bob Peeters, Senior Manager of WCO IPM Private Sector Team introduced IPM Program. Mr. Bob Peeters reviewed training and operation mode of IPM Program among countries in the years of 2015 and 2016, and shared the positive influence that the project exerted on intellectual property protection. From the show of Mr. Bob Peeters, QBPC members noticed officers around the world who apply IPM Program and the percentage that right holders take in all fields. Through Mr. Bob Peeters’ introduction, members further popularized knowledge in intellectual property protection in Customs.
 

Ms. Duan Xiaomei, Director of SAIC Trademark Review and Adjudication Board, made a speech on the subject of Deterring the Bad Faith Registration by the Applying the Trademark Review and Adjudication Procedure. Director Duan explained main content of Amendment on Trademark Law relating to Trademark Review and Adjudication Procedure, and analyzed legal characteristics of Bad Faith Registration. Director Duan further introduced measures and efforts that Trademark Trial and Appeal Board took towards deterring the Bad Faith Registration in recent years, and shared some relevant model cases with members. Finally, combined with many years of work and personal experience, Director Duan put forward two suggestions to members. One is to enhance trademark registration and protection awareness, and the principle of exhaustion; the other is to fully apply review and adjudication procedure and relevant judicial proceedings.

Mr. Lin Guanghai, Vice President of Guangzhou IP Court, made a speech on Introduction of the work of Guangzhou IP Court. Vice President Lin took Guangzhou IP Court as an example, to review the history and development of Chinese IP Court. Vice President Lin gave a detailed elaboration on five aspects of policy, stratagem, strategy, tactics and intellectual property fortress of intellectual property judicial protection. At the final stage of the meeting, Mr. Huang Yong, Professor of University of International Business and Economics School of Law and Head of Competition Law Research Center of the University of International Business and Economics, spoke on Anti-Monopoly Issues Related to Intellectual Property. He proposed topics of state intellectual property protection and the limit between enforcement of the Anti-monopoly Law and administration of justice, and the relationship between state intellectual property strategy and Anti-monopoly.
 

Keynote Speech Session of membership meeting of QBPC in a half day is efficient and substantial. The Keynote Speeches of guests has provided members with theoretical guidance and provoked members’ further thinking on intellectual property protection. The QBPC May Membership Meeting has brought experience exchange opportunities of the cause of intellectual property protection to enterprises members and made everyone participated beneficial.
