QBPC and Shandong FDECID Hold Exchange on Criminal Protection of IPR

On October 15, the Quality Brands Protection Committee of China Association of Enterprises with Foreign Investment (QBPC) and the Food, Drug, and Environment Crime Investigation Department of the Public Security Bureau of Shandong Province (Shandong FDECID) held a successful exchange meeting on criminal protection of IPR in Suzhou. The event was attended by officials from Shandong FDECID and its subordinate branches, the People’s Procuratorate of Shandong Province, the High People's Court of Shandong Province, the Shandong Administration for Market Regulation, Qingdao Customs, Jinan Customs, e-commerce platforms, and QBPC member company representatives.

    

In his opening remarks, Chief Captain Jian SHI, on behalf of the Shandong FDECID, thanked relevant government agencies for their support in this exchange as well as their cooperation in combating IPR infringement crimes. With increased in-depth communication with the QBPC, both parties had achieved a lot through joint efforts. SHI detailed the combating results and innovative initiatives of the Department which highlighted the ability and determination of the public security bureaus and right holders to fight together against IPR infringement crimes.

Peter Yang from the QBPC Best Practices/Enforcement Committee reviewed the collaboration between the QBPC and Shandong FDECID over the years. He stated that with the Department’s strong support, the cooperation between the two sides had deepened and innovated, resulting in new breakthroughs. Through unremitting efforts, the Department and all related detachments had made outstanding achievements in protecting the legal rights and interests of right holders while promoting the development of IP protection in China. Regarding this, Peter, on behalf of the QBPC, expressed his high respect and heartfelt thanks as well as looking forward to further broadening cooperation with the Shandong FDECID in order to achieve mutual benefits and win-win situation at a higher level and in more dimensions, which would comprehensively promote the social co-governance of IP protection.

[Topic Speeches: New Trends, Difficulties and Hot Issues in Criminal Protection of IPR]

Bin GAO first introduced their work for IPR criminal protection, the status quo of IP crimes in Shandong Province, and the prospect. Shuo SUN from the Provincial Procuratorate detailed the trade secrets “Trinity” comprehensive protection mechanism. Yuejing XU from Qingdao Customs discussed how the Customs had built strong border protection  against IPR infringements through maintaining high-pressure on infringers, deepening synergistic co-governance, and improving the convergence of administrative and criminal enforcement. She also analyzed challenges and put forward suggestions. Tao LI from Ji’nan Customs presented their IPR protection methods, situation, and suggestions of the convergence of administrative and criminal enforcement. Afterwards, the representatives of Mosaic Fertilizers (Beijing) Co., Ltd., Caterpillar, Siemens, Moët Hennessy, Kering and Dyson, respectively on behalf of Agricultural, Automotive, Electric & Automation, Food, Beverage, and Alcohol, Luxury Goods, and Home Appliances IWGs, explained the situation of relevant industries, the infringement trends, and the priorities and difficulties in IPR protection.

 

[Topic Speeches: Best Practice Cases Sharing and Reflection]

Officials from Weihai, Rizhao, Ji’nan, Yantai FDECID, and the representative of QBPC member company SKF shared the characteristics and highlights of relevant cases and their successful experience of collaboration.

[Panel Discussion on lP Protection Opportunities and Challenges]

Kang LIU from Shandong FDECID, Tao ZHANG from Qingdao Detachment, Nuo ZHANG from JD.com, Inc., and Felix ZHANG from Novartis spoke on their experience and shared different perspectives on the current situation of IPR protection, as well as the opportunities and challenges that they faced.

 

[Panel Discussion on Innovation and Cooperation in IP Protection]

Jieshu WAN from Huangdao Customs, Min ZHANG from Zichuan Brigade in Zibo City, Yansheng YANG from Shouguang Brigade in Weifang City, Ping SUN from Douyin Co., Ltd, and Yan Zhang from Novonesis discussed how to stimulate innovation, and promote scientific and technological progress and economic development while protecting IPR.

   

Finally, GAO delivered a closing speech. According to him, Shandong FDECID always adopted an attitude of openness and tolerance, and win-win cooperation to carry out criminal protection of IPR. He expected to deepen the cooperation with QBPC and other relevant agencies on the IPR protection, build a new model of collaborative co-governance, pay close attention to the industry dynamics, exchange clues and intelligence, and jointly promote the work of criminal protection of IPR to a new level.
