The 2nd Seminar on Hot & New Topics of Trademark and Copyright

On August 11, the Quality Brands Protection Committee of China Association of Enterprises with Foreign Investment (QBPC) Legal Committee and the Intellectual Property Practice Research Committee of the Shanghai Bar Association (SHBA) co-organized the second seminar on hot issues of trademark and copyright. The seminar drew numerous intellectual property specialists, scholars, and industry practitioners to discuss relevant critical issues, and over 50 QBPC representatives attended both onsite and online.

Ma Mengmeng, Legal Committee Vice-Chair, presided over the seminar. She stated that intellectual property had gained popularity among practitioners and the general public as the intersection of law and business, and the seminar aimed to provide a platform for exchange and learning. Fu Gang, Deputy Director of SHBA, delivered a presentation on "Preventing and Responding to Software Copyright Infringement". Fu explored general software piracy and legalization from multiple perspectives and elaborated on the precautions to be taken in the licensing procedure.

Then Chen Yuhe illustrated six typical cases to discuss how to deal with copyright infringement of fonts and images from four perspectives: legal attributes of fonts, images ownership verification, reasonable usage of fonts and images, and characteristics of and responses to disputes over infringement of fonts and images.

Afterwards Tan Yaowen provided a brief overview of the derivative licensing market before delving into four classic cases involving animation images and hot cases in order to conduct an in-depth analysis of the problem of animation image plagiarism and help the audience to understand the judge’s thinking in handling the cases.

In the end, Huang Yangyang discussed background music copyright infringement and its response strategies from four aspects, including background music application scenarios and dispute cases, usage cases, infringement trial thinking, and compliance recommendations.

Sha Haitao, Deputy Director of SHBA, and Zhang Hongkai, Vice-Chair of QBPC Best Practices/Enforcement Committee, made remarks and share their own views, delivering valuable insights and suggestions.
